1. Definitions

For the purposes of these Terms of Service:

  • “Company”, “we”, “us”, or “our” refers to Soundphonium Limited, operating the website saysim.io.

  • "Website" refers to the domain saysim.io and all related pages, subdomains, or services accessible through it.

  • “User”, “Customer”, or “End User” refers to any individual accessing the Website, registering an account, purchasing or activating an eSIM, or otherwise using the Services.

  • “Account” means the personal profile created by the User to access and manage services.

  • “Service” or “Services” refers to the purchase, activation, provisioning, and use of data-only eSIM mobile data plans.

  • “eSIM” refers to the digital SIM profile that allows mobile data connectivity without a physical SIM card.

  • “Service Provider / Carrier Partner” refers to third‑party telecommunications operators whose networks Users access via an eSIM purchased on saysim.io.

  • “Data Credits”, “Credits”, or “Account Balance” refers to non-refundable virtual tokens stored in a User’s Account.

  • “Activation” means downloading and enabling the eSIM profile on a compatible device.

  • “Service Order” refers to a confirmed purchase made by the User through saysim.io, where payment is successfully processed, granting the User access to an eSIM data plan.

  • “Effective Date” means the date on which the User accepts these Terms or submits an order.

2. General Validity of the Terms

2.1 These Terms constitute a legally binding agreement between the User and Soundphonium Limited.

2.2 Before registering, purchasing, activating, or using any Services provided via saysim.io, the User must read, understand, and accept these Terms fully.

2.3 If the User does not agree to these Terms, the User is not authorized to use the Website or the Services.

2.4 The Company reserves the right to modify these Terms at any time. Updates become effective upon publication on the Website. Continued use of the Services indicates acceptance of the updated Terms.

3. Description of Services

3.1 saysim.io provides international data-only eSIM plans, allowing Users to access mobile data in supported countries and regions.

3.2 The Company does not provide:

  • Voice calling services,

  • SMS sending or receiving,

  • Emergency calls (112, 911, etc.). Users must have an alternative method available.

  • Physical SIM cards.

3.3 Network speed and availability depend on regional network infrastructure and Service Provider / Carrier Partner policies.

3.4 The Company does not guarantee specific network speeds.

4. User Registration and Information Requirements

4.1 To use the Services, the User may be required to create an Account and provide the following personal information:

  • First name and last name

  • Email address

  • Phone number

  • Date of birth

4.2 By creating an Account or using the Services, the User confirms that:

  • They are at least 18 years old,

  • All information provided is accurate, complete, and current,

  • They will update the information if any change occurs.

4.3 Users are fully responsible for the accuracy of the information provided. The Company is not liable for issues resulting from incorrect or outdated information.

4.4 If the User provides false, misleading, or incomplete information, the Company may suspend or terminate the Account or cancel the Services without refund.

4.5 User must verify device compatibility before purchase.

4.6 Users are responsible for securing their login credentials.

5. Formation, Duration, and Termination of Contract

5.1 A contract is formed when the User completes an order on saysim.io.

5.2 The contract automatically terminates when the purchased data plan validity period expires.

5.3 The Company may suspend or terminate the contract and cancel Services if:

  • The User violates these Terms,

  • Fraud, abuse, or suspicious activity is detected,

  • False identity or incorrect data is provided.

6. Fees and Payment

6.1 Payments are collected prior to delivery of the eSIM via credit/debit cards. Users may also fund their Account by purchasing Data Credits (platform tokens), which can be used to pay for Services.

6.2 All payments are processed securely by third-party payment providers. The Company does not store payment card details. When purchasing Data Credits, the User receives a virtual balance in their Account. 1 Data Credit = 1 EUR equivalent value on the platform.

6.3 Unless stated otherwise, all prices are displayed in EUR and include applicable taxes.

6.4 Charge disputes must be submitted to the Company via email within 10 days of the charge.

6.5 Users must pay the full amount displayed at checkout for every order. Payment cannot be delayed, withheld, or reduced because of a dispute or claim. If the User believes they are owed a refund or compensation, that claim will be handled separately and does not affect their obligation to pay for new or existing orders. If Credits (Data Credits) are used during checkout, those Credits are deducted immediately and cannot be returned to monetary form.

6.6 Plans are one-time purchases and do not auto-renew.

7. eSIM Delivery

7.1 Upon successful payment, the eSIM profile and activation instructions are ent to the User’s email.

7.2 Once deleted, the eSIM cannot be reissued without a new purchase.

7.3 Once the eSIM is delivered to the User, it becomes the User’s sole responsibility to activate and use it correctly. Proper use includes, but is not limited to:

  • Ensuring the device is eSIM-compatible and unlocked,

  • Following activation instructions provided on the Website or email,

  • Enabling mobile data and data roaming where required,

  • Users must enable data roaming and configure APN/data settings.

8. Data Credits and Promotional Balance

8.1 Credits (Data Credits) are virtual and have no monetary or exchangeable value outside the Website. Credits represent internal platform tokens, where 1 Data Credit = 1 EUR of purchasing power within saysim.io.

8.2 Credits are generally non-refundable, non-transferable, and cannot be exchanged for cash.

8.3 However, in exceptional cases, refund eligibility may be considered at the Company’s discretion. Each case is evaluated individually by the support team within 10 business days.

8.4 All refund or review requests related to Credits must be submitted by email to: queries@saysim.io

8.5 Approval of any refund or adjustment to the User’s Credits is not guaranteed and depends on:

  • Reason for the request,

  • Account activity and usage history,

  • Compliance with these Terms.

8.6 Abuse of promotions or attempts to manipulate Credits may result in credit removal and/or account suspension.

9. Refund, Cancellation, and Modification Policy

9.1 Refunds may be considered in cases where the Service cannot be used due to a technical issue caused by the Company or its Service Providers, or in other exceptional circumstances evaluated at the Company's discretion. Refunds are not guaranteed and are assessed individually based on the specific case and supporting evidence.9.2 Refund requests must be submitted within 30 days of purchase.

9.2 To request a refund, the User must submit a written request by email to queries@saysim.io within 30 days of the purchase date.

9.3 The User must cooperate and provide sufficient proof of the issue, including but not limited to:

  • Screenshot(s) of the error or activation issue,

  • Device model and operating system version,

  • Confirmation that the device is eSIM-compatible and unlocked,

  • Proof that activation steps provided by the Company were correctly followed.

9.4 Refunds will not be issued if:

  • The User's device is not eSIM-compatible or is carrier-locked,

  • The User deleted the eSIM profile after installation,

  • The User failed to follow activation instructions or configure device settings (e.g., data roaming disabled),

  • Data remains unused after plan expiration or consumption,

  • The User changed their mind or purchased by mistake,

  • Network coverage or speed is limited in certain regions (e.g., remote or obstructed areas).

9.5 If a refund request involves Credits, such cases are reviewed individually. Credits are generally non-refundable, however, exceptions may be considered at the Company's discretion. Evaluation is completed within 10 business days of receiving the request at queries@saysim.io.

9.6 Refunds, if approved, are issued only to the original payment method used during purchase.

9.7 Once activated or used, the eSIM plan cannot be modified, paused, transferred, or refunded.

10. Privacy and Data Protection

10.1 The Company collects and processes only the personal data required to provide the Service and operate the User’s Account.

10.2 Users may request deletion of their Account or unsubscribe from marketing communications at any time by contacting support.

11. Service Management and Fair Usage Policy

11.1 The Company may apply restrictions to protect the network if abnormal usage is detected.

11.2 Users are prohibited from:

  • Reselling or sharing eSIMs for commercial use,

  • Attempting to modify, duplicate, or reverse engineer eSIM profiles.

11.3 Fraudulent activity (including chargeback abuse) may result in Account closure and legal action.

12. Limitation of Liability

12.1 The Company is not liable for:

  • Poor or unavailable signal in remote or obstructed areas,

  • Telecom carrier outages, maintenance, or network disruptions,

  • Device incompatibility or misconfiguration,

  • Indirect or consequential damages (profit loss, business interruption, etc.).

12.2 Users assume full responsibility for ensuring compatibility of their device before purchasing.

13. Governing Law and Dispute Resolution

13.1 These Terms are governed by the laws of England and Wales.

13.2 If negotiations cannot resolve a dispute, it shall be submitted to arbitration in the United Kingdom.

14. Legal Provisions

14.1 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid portion shall be interpreted in a manner that best reflects the original intent and allows enforcement to the fullest extent permitted by law.

14.2 Entire Agreement
These Terms constitute the entire agreement between the User and the Company regarding the use of the Services and supersede any prior agreements, communications, or understandings, whether written or verbal. No representation, statement, or promise not contained herein shall be binding.
